Child Care Advice / Parental Responsibility

Your legal rights as a Parent: 

The biological mother of the child has automatic parental responsibility of child from birth. 

The father of the child will have parental responsibility if, he was married to the mother either when the child was born or subsequently. A father who’s not married to the child’s mother will have automatic parental responsibility if the child was born after December 1st 2003 and if they’re listed on the child’s birth certificate.

How a father can gain parental responsibility?

  • By getting a parental responsibility agreement with the mother, which must then be registered
  • By getting a parental responsibility order from a court
  • By getting a child arrangement order from the court to determine who the child will live with or spend their time with

It is important to note that the parental responsibility obtained lasts only as long as the order remains in force.
